Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Indies At War website, games, and related services (the “Service”). By accessing or using the Service, you agree to these Terms and to our Privacy Policy and Cookies Policy. If you do not agree, do not use the Service.
1. Eligibility & Accounts
- You must be at least 13 years old to use the Service. If you are in the EEA/UK, you must be at least 16 unless parental consent applies under local law.
- Provide accurate registration information and keep it current. You are responsible for all activity on your account and for safeguarding your credentials.
- We may refuse, suspend, or terminate accounts that violate these Terms or our policies.
2. Acceptable Use
- No cheating, exploiting bugs, manipulating network traffic, or attempting to gain unauthorized access.
- No posting illegal, infringing, deceptive, hateful, or harassing content.
- No submitting fraudulent runs or scores. We may remove suspect entries and apply suspensions or bans.
- Do not interfere with or degrade the Service, or use it for unlawful purposes.
3. Virtual Items, Store Purchases & Taxes
Purchases of digital content or virtual items are generally final except where required by law. Virtual items have no real-world monetary value and cannot be exchanged for cash. Prices may change at any time. You are responsible for any taxes, duties, or fees applicable to your purchases. See Refunds & Returns and Shipping for details on physical goods (if offered).
4. Intellectual Property
The Service (including software, artwork, logos, and content) is owned by Indies At War or its licensors and is protected by applicable intellectual property laws. We grant you a limited, revocable, non-transferable license to use the Service for personal, non-commercial purposes, subject to these Terms. All rights not expressly granted are reserved.
5. User-Generated Content
You retain ownership of content you submit (e.g., profile info, screenshots, feedback). You grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, reproduce, distribute, display, and create derivative works from that content for operating and promoting the Service. Do not upload content you don’t have the right to share. We may remove or refuse content that violates the law or these Terms.
6. Leaderboards & Anti-Cheat
We may moderate or audit leaderboards. We can remove entries we reasonably believe to be inaccurate or obtained through cheating or exploitation and may suspend accounts to preserve competitive integrity.
6A. Community Rules (Usernames, Comments, Reporting & Enforcement)
To keep the community fair and safe, the following rules apply to usernames, profiles, comments/community features (if enabled), and any content you submit. These rules apply in addition to Sections 2 and 5.
- Be respectful: no hate speech, harassment, threats, sexual or violent content targeting individuals or groups, or doxxing.
- Impersonation & misrepresentation: do not impersonate Indies At War staff, partners, public figures, or other users; parody must be obvious.
- Illegal or infringing content: no unlawful content, malware, scams, promotion of illegal activity, or content that infringes third-party IP rights.
- Spam & manipulation: no spam, automated posting, or artificial boosting of scores/visibility.
- Usernames/aliases: must be appropriate and non-infringing. We may rename or reclaim usernames that are offensive, infringing, impersonating, brand-confusing, or long-term inactive.
- Moderation & enforcement: we may remove content, rename accounts, reset/prune leaderboard entries, restrict features, or suspend/ban accounts (temporary or permanent). Ban evasion is prohibited.
- Reporting: report violations to support@indiesatwar.com. We cannot pre-screen all content but we will review reports and act where appropriate.
- Appeals: if you believe an action was taken in error, contact support with context. Decisions are at our reasonable discretion.
- Legal requests & safety: we may cooperate with rights holders and authorities where required by law or to protect safety (see our Privacy Policy for how we handle data).
7. Third-Party Services
We integrate with third-party providers (e.g., Stripe for payments, Supabase for auth/game services). Their services are subject to their own terms and privacy policies. We are not responsible for third-party websites or services.
8. Beta Features & Service Changes
From time to time, we may offer experimental or beta features. These are provided “as is,” may be unstable, and may be modified, suspended, or discontinued at any time.
8A. Compatibility & System Requirements
The Service’s performance and availability depend on your device, operating system, graphics hardware and drivers (e.g., NVIDIA/AMD), and other third-party software. We may publish minimum and recommended specifications; however, we do not guarantee compatibility with every device, OS build, or driver version.
- Third-party updates: changes introduced by operating systems, GPU drivers, security software, or OEM utilities may affect performance or stability. We are not responsible for issues caused by third-party updates outside our control.
- Workarounds and patches: if a widespread incompatibility arises (for example, a new GPU driver causes crashes), we will investigate, document known workarounds (which may include rolling back to a stable driver), and, where feasible, ship an update.
- User environment: you are responsible for maintaining a supported configuration, including installing supported drivers/OS updates and ensuring sufficient hardware resources.
Nothing in this section limits your non-waivable consumer rights (e.g., where mandatory law provides remedies for digital content that is not in conformity). For damages claims, the Limitation of Liability in Section 11 applies.
9. Termination
We may suspend or terminate access if you violate these Terms, pose a security or legal risk, or misuse the Service. You may delete your account at any time via Dashboard → Profile Settings → Delete Account. Data handling on deletion is described in our Privacy Policy.
10. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.
- No performance guarantees: gameplay performance and availability may vary by device, OS, drivers, and other software (see Section 8A).
- Beta & experimental features: may be incomplete, contain bugs, or change at any time (Section 8).
- Third-party services & links: we are not responsible for third-party content, services, or availability, even if linked or integrated.
- No professional advice: information provided via the Service (including support responses) is for general informational purposes and not professional advice.
- Scores & rankings: leaderboards may be audited or reset to preserve integrity; we do not warrant the accuracy or persistence of any particular rank.
11. Limitation of Liability
To the maximum extent permitted by law, Indies At War and its affiliates, officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for lost profits, data, or goodwill, arising from or relating to your use of the Service. Where liability cannot be excluded, it is limited to the amount you paid to us for the Service during the 12 months preceding the claim.
12A. Support Policy
- How to contact: email support@indiesatwar.com. We may add channels in the future.
- Hours & response targets: we aim to respond within 2–3 business days (Lisbon time, Mon–Fri, excluding public holidays). These are targets, not guarantees. Security/ payment issues are prioritized.
- What we cover: account access, purchase/charging issues, order and shipping problems, suspected bugs, and general gameplay questions.
- Out of scope: configuring third-party hardware/software (drivers, overclocking, mods), operating-system issues, ISP/network problems, or damage caused by unsupported tools. We may still offer best-effort guidance.
- Verification: we may ask you to confirm account ownership or provide order IDs, receipts, screenshots, logs, or crash dumps. Handling of personal data follows our Privacy Policy.
- Conduct: abusive or harassing behavior toward staff is not tolerated and may result in account restrictions or closure.
- Languages: support is available in English and Portuguese.
12. Indemnity
You agree to indemnify and hold harmless Indies At War from any claims, losses, liabilities, damages, and expenses (including reasonable legal fees) arising from your breach of these Terms or misuse of the Service.
13. Governing Law & Venue
Subject to mandatory consumer protection laws and jurisdiction rules that cannot be excluded, these Terms and any dispute or claim (contractual or non-contractual) arising out of or in connection with them or the Service are governed by the laws of Portugal, without regard to conflict-of-laws principles. Without prejudice to mandatory rules on jurisdiction (especially for consumers), the courts of Lisbon, Portugal, shall have jurisdiction.
If you are a consumer in the EU/EEA or the UK, you also benefit from any mandatory consumer protections afforded by the law of your habitual residence, and you may bring proceedings in your local courts where this is required by law. If you are outside the EU/EEA/UK, you may have mandatory consumer rights under your local law; nothing in this clause limits those rights.
14. Miscellaneous
- Severability. If any provision is found unenforceable, the remaining provisions will remain in effect.
- No Waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
- Assignment. You may not assign these Terms without our prior written consent; we may assign them as part of a merger, acquisition, or asset sale.
- Force Majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
- Entire Agreement. These Terms, together with linked policies, constitute the entire agreement between you and us regarding the Service.
15. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date will reflect the latest version. Material changes will be reasonably notified (e.g., via the site). Continued use after changes constitutes acceptance.
