End User License Agreement (EULA)

This End User License Agreement (“EULA”) is a legal agreement between you (“you” or “Licensee”) and Indies At War (“Licensor”, “we”, or “us”) covering your use of our game software currently titled Indies at War: Crimson Waves and any related launchers, tools, updates, and content (collectively, the “Software”). By installing, accessing, or using the Software, you agree to be bound by this EULA. If you do not agree, do not install or use the Software.
1. License Grant
Subject to your compliance with this EULA and our Terms of Service, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download, install, and use the Software on devices you own or control for your non-commercial use.
2. Restrictions
- No resale, rental, lease, sublicensing, or public performance of the Software.
- No reverse engineering, decompiling, disassembly, or circumvention of security/DRM, except to the extent expressly permitted by applicable law.
- No modification, adaptation, translation, or creation of derivative works without our prior written consent.
- No use of unauthorized tools (cheats, bots, automation, memory editors) or interference with network traffic or leaderboards.
- No use that violates laws, infringes third-party rights, or breaches our policies.
3. Ownership
The Software is licensed, not sold. We and our licensors retain all rights, title, and interest in and to the Software, including all intellectual property rights. All rights not expressly granted are reserved.
4. Updates; Pre-release/Beta
We may provide patches, updates, or new versions, which may be required for continued use. Pre-release or beta features are provided “as is,” may be unstable, and may be modified or removed at any time.
5. Compatibility & System Requirements
Performance depends on your hardware, OS, GPU drivers (e.g., NVIDIA/AMD), and third-party software. We may publish minimum/recommended specifications but do not guarantee compatibility with every configuration. If a third-party update (e.g., a GPU driver) causes issues, we will investigate and, where feasible, document workarounds or provide an update. Your maintenance of a supported environment is required.
6. Online Features; Leaderboards & Anti-Cheat
Online features (including leaderboards) require internet connectivity and may use server-side validation and limited telemetry to preserve competitive integrity. We may audit or remove suspect entries and suspend accounts that violate fair-play rules. See our Privacy Policy for data details.
7. User-Generated Content & Feedback
You remain the owner of content you submit (e.g., profile info, screenshots). You grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, reproduce, adapt, distribute, and display such content for operating and promoting the Software and related services. You represent you have the necessary rights to grant this license.
8. Streaming & Content Creation
We permit you to capture, stream, and monetize gameplay videos and screenshots of the Software for editorial or entertainment purposes, provided you do not misrepresent affiliation, leak confidential content, or infringe third-party rights. Use of our trademarks and branding is subject to our guidelines and applicable law.
9. Modding
Unless we expressly provide official tools or written permission, you may not modify, distribute, or create derivative works of the Software. Any permitted mods must not enable cheating, unlock paid content, or compromise security.
10. Data; Telemetry
We may process limited technical and gameplay data to operate features (e.g., leaderboard validation, crash diagnostics). Personal data is handled as described in our Privacy Policy.
11. Health & Safety
A small percentage of individuals may experience seizures or blackouts when exposed to flashing lights or visual patterns, including in video games. If you experience dizziness, altered vision, eye or muscle twitches, loss of awareness, involuntary movements, or disorientation, stop playing and consult a doctor. Take regular breaks and play in a well-lit environment.
12. Termination
This EULA is effective until terminated. We may suspend or terminate your license if you breach this EULA or misuse the Software. Upon termination, you must cease all use and delete all copies. Account deletion and data handling are described in our Privacy Policy.
13. Warranty Disclaimer
The Software is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Your use is at your sole risk.
14. Limitation of Liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for lost profits, data, or goodwill, arising out of or relating to the Software. Where liability cannot be excluded, it is limited to the amount you paid to us for the Software in the 12 months preceding the claim (if any). This clause does not affect non-waivable consumer rights or liability that cannot legally be excluded.
15. Export Controls & Sanctions
You must comply with applicable export control and sanctions laws and may not use, export, or re-export the Software in violation of such laws.
16. Governing Law & Venue
This EULA and any dispute or claim arising out of or in connection with it are governed by the laws of Portugal, without regard to conflict-of-laws principles. You submit to the exclusive jurisdiction of the courts of Lisbon, Portugal. If you are a consumer in the EU/EEA or the UK, you also benefit from any mandatory consumer protections afforded by the law of your habitual residence.
17. Miscellaneous
- Severability. If any provision is held unenforceable, the remaining provisions remain in full force.
- No Waiver. Failure to enforce a provision is not a waiver of the right to do so later.
- Entire Agreement. This EULA, together with our Terms of Service and Privacy Policy, is the entire agreement regarding the Software.
- Third-Party Components. The Software may include third-party components subject to their own licenses and notices.
